Waiver & Release of Liability:
I give voluntary permission for my child to participate in classes, workshops, events, therapies, and/or services (collectively, the “Activities”) offered by Sage & Tansy Studio (“Studio”) and/or its owners, instructors, volunteers, tenants, service providers, employees, and independent contractors. The Activities may be offered in the physical location of the Studio (24 W. Main St. in Ione), at another location, or offered online by videos or other digital media/platforms. All of such offerings, either physical or online, shall be considered “Activities.”
I understand that participating in these Activities involves risk of damage, illness, or injury. I represent and warrant that my child is in good physical and mental health and has no medical condition which would prevent his/her safe participation in the Activities. I understand that it is my responsibility to consult with a physician if appropriate, prior to and regarding my child’s participation in the Activities. If I have consulted a physician, I have taken the physician’s advice. I further understand that it is my responsibility to request and complete a new waiver form on future visits to the Studio (either physical or online), if my child experiences a change in health which may affect his/her safe participation in Activities.
I understand that Studio representatives reserve the right in their absolute discretion to refuse my child’s participation in any Activity due to medical, safety, or fitness concerns, or on any other grounds.
In consideration of being permitted to participate in the Activities, I agree to assume full responsibility and liability for any risks, injuries, or damages to person or property, known or unknown, which might occur as a result of my child’s participation in Activities offered by the Studio. In further consideration of being permitted to participate in the Activities, I knowingly, voluntarily and expressly waive any claims I may have against the Studio, its owners, employees, instructors, service providers, volunteers, independent contractors, and/or tenants (each, a “Released Party”) for any injuries, loss, or damages that my child (and anyone accompanying my child) may sustain as a result of participating in Activities offered by the Studio. Myself and/or any of my heirs, executors, representatives, or assignees hereby release, discharge, and covenant not to sue any Released Party. I agree to indemnify and hold harmless each Released Party from any loss or liability incurred in defending any Claim made by me, or anyone making a Claim on my behalf, even if the Claim is alleged to, or did result, from the carelessness or negligence of any Released Party.
Photo/Video Release: I understand that Studio representatives may photograph or video Activities, and use such photographs and videos for the Studio website, social media accounts, and marketing materials. I hereby consent to the use of my child’s image, which may appear in any such photographs or videos.
This agreement shall be construed in accordance with, and governed by, the laws of the State of California. I acknowledge that I have carefully read this waiver and release of liability and fully understand its contents. I voluntarily and knowingly agree to the terms and conditions stated herein. I am aware that by signing this form, I am giving up substantial rights, including my right to sue and certain legal rights my heirs, next of kin, executors, administrators, and assignees may have against any Released Party. I acknowledge that this agreement will remain in effect unless specifically terminated in writing by either party.
